Article 1. General Provisions

1.

The passenger transportation contract (“the Contract”) is formulated according to Article 73 of Railroad Transportation Regulations.

2.

The terms used in the Contract are defined as follows:

Child:

A person who is under 12 years old.

Invalid ticket:

fail to take the train in accordance with the usage regulations or the information recorded on the ticket, take the train by using the ticket type which the user is not qualified, take the train over station or take the train at the time of expiration of ticket.

Without ticket:

does not use the ticket while entering the station to take the train, the entering record is not marked while entering the station to take the train by using electronic ticket, fail to present concrete ticket or the electronic ticket which has been marked the entering record while checking ticket, exceed the valid section of ticket, turn back for taking the train.
Without permission, take the train or car with non-reserved seat, which Taiwan Railway Corporation, Ltd. has published that the tickets are not for sell.

Take train over station:

the passenger takes the train at the station other than valid section recorded on the ticket.

Preference:

means the discount which is provided based on specific legal identity.

Special offer:

means the discount which is provided to general passengers in consideration of improvement of sales of Taiwan Railway Corporation, Ltd.

The section which has been taken:

the section which has been taken by the passenger from the departure station to the station where the passenger gets off, or the driving section from the departure station to the next stop.

Turn-back boarding:

after the passenger has arrived the destination recorded on the original ticket, the passenger takes the train from the original destination station to the middle station included in the section of the original ticket.

Get off halfway：

means that the passenger gets off the train at any of the stations in the section between the departure station and destination station recorded on the ticket and goes out of the station, and then enters the station within the valid period and goes on taking the train.

Article 2. Business Hour and Ticketing Hour

3.: The business hour of each station starts from the time 30 minutes prior to the departure of the first train to the time ten minutes after the departure of the last train. However, if it is necessary to operate the train transportation business out of business hour, the business will be operated from the time 30 minutes prior to the arrival of the train to the time ten minutes after the departure of the train.
4.: The business hour of the station ticketing stand is the same as the business hour of the station. However, under special circumstances, the ticket will be sold according to the business hour published by the station.

Article 3. Establishment of Transportation Contract and Refusal of Transportation.

5.

The following situations are deemed that Taiwan Railway Corporation, Ltd. has promised the transportation, and the transportation contract shall be deemed to be established:

(1): The passenger has placed an order of ticket through Taiwan Railway Corporation, Ltd.’s website or telephone and completed the payment.
(2): The passenger has purchased tickets at the station ticketing stand, ticketing equipment or designated channels.
(3): At the station where no personnel is on duty, the passenger has entered the car and taken the train.
(4): At the time Taiwan Railway Corporation, Ltd. has delivered the transportation voucher or ticket to passenger.
(5): The passenger has used the electronic tickets and the entering record has been noted by electronic ticket equipment.
(6): Other situations which shall be deemed to be the establishment of contract according to laws.

6.

In the event of any of the following conditions pertaining to the passenger, Taiwan Railway Corporation, Ltd. may refuse to transport, cancel the contract or terminate the contract:

(1): The passenger is in breach of the transportation regulations of Taiwan Railway Corporation, Ltd., other laws and regulations, public policy or morals.
(2): The passenger demands any special obligations or duty for railroad transportation.
(3): The passenger wears stinky clothes or brings dirty items which affect public hygiene.
(4): Natural disaster, emergency incidents or any other situations of force majeure matters cause the failure of transportation.
(5): The passenger has any acts which are believed to pose an obvious risk of hurting himself/herself or other people, or has any acts of harassing other people.
(6): The passenger need escort but there is no one escorting him/her.
(7): Taiwan Railway Corporation, Ltd. has no required facilities or equipment while transporting, except that Taiwan Railway Corporation, Ltd. shall set such facilities or equipment according to laws but Taiwan Railway Corporation, Ltd. has not set.
(8): The passenger has suffered from contagious disease that may jeopardize public hygiene or social peace.
(9): The passenger carries any item whose nature may cause damage to persons or property.
(10): In the train station or cars, the passenger has any acts which jeopardize the order, safety, traffic flow of train waiting without following the announcement of Taiwan Railway Corporation, Ltd. or the reminders from the personnel of station or cars and fails to make improvements as advised.

7.

If the transportation of passenger meets the exception provision set forth in the Subparagraph 7 of preceding Point, Taiwan Railway Corporation, Ltd. will arrange suitable method for transportation.

8.

When the passenger breaches any of the provisions of Article 71 of Railway Act and cannot take the train, the ticket fare of the remaining itinerary will not be refunded by Taiwan Railway Corporation, Ltd.

Article 4. Regulations of Ticketing and Calculation of Ticket fare

9.

The types of tickets sold by Taiwan Railway Corporation, Ltd. are as follows:

(1): Full-priced ticket.
(2): Legal preference ticket (Ticket for elder& disabled).
(3): Child ticket.
(4): Group ticket.
(5): Other tickets issued by announcement according to the business need.

For the name, usage regulations, precautions of the other tickets mentioned in Subparagraph 5 of preceding Paragraph, the use guide will be otherwise provided by Taiwan Railway Corporation, Ltd. and announced in stations or recorded on tickets. For the tickets which has not been provided use guide will apply to the provisions of the Contract.

10.

After the passenger has finished placing an order of ticket, the passenger shall complete the payment within Taiwan Railway Corporation, Ltd.’s announced deadline for taking the ticket.
The payment for the expenses of special express and charter shall be completed within the deadline agreed by Taiwan Railway Corporation, Ltd. and the passenger.
If the payment of the situations set forth in the preceding two subparagraphs fail to be completed within the announced deadline or the agreed deadline, the transportation contract shall be cancelled, and Taiwan Railway Corporation, Ltd. may request penalties for the group passenger, special express and charter expenses.
The penalty in the preceding subparagraph shall be requested in accordance with the following provision: to group passengers, special express passenger and charter passenger, the penalty shall be calculated according to refund surcharge, reservation fee or deposit of group ticket, and the maximum amount shall not exceed 40% of the payable ticket fare.

11.

he ticket fare shall be calculated as follows:

(1)

Ticket fare rate for each level of trains:

1.: Tze-Chiang Limited Express and the trains in same level: NTD 2.27/ km for each person.
2.: Chu-Kuang Express and the trains in same level: NTD 1.75/ km for each person.
3.: Fu-Hsing Semi Express and the trains in same level: NTD 1.46/ km for each person.
4.: Ordinary Train and the trains in same level: NTD 1.06/ km for each person.

(2)

The calculation of ticket fare:

1.: Ticket fare shall be calculated as follows: fare rate for each level of trains multiplied by actual travel distance, and the amount less than one dollar shall be rounded to the nearest integer. However, if the single round travel is less than 10 km, the rare shall be calculated as 10 km.
2.: The starting mileage for the ticket fare of each branch line is 10 km, every 3.5 km is deemed one section. In the event of exceeding 10 km, every 3.5 km shall be requested NTD 5; if the additional distance is less than 3.5 km, it shall be calculated as 3.5 km.
3.: While the passenger is on the way to each station in the north of Zhunan from each station in the south of Changhua and pass through Mountain Line and Coast Line, the fare shall be calculated according to the mileage of Mountain Line and Coast Line. However, while taking the train between Mountain Line and Coast Line, the fare shall still be calculated according to actual mileage.
4.: The minimum unit of the mileage calculation is 0.1 km.

(3)

The calculation of the fare of charter car shall be based on fixed people amount in car multiplied by the train’s level fare. If the actual amount of the people taking the train exceed the fixed people amount, the fare of the exceeding amount shall be calculated according to the actual amount of the people taking the train, and the fare shall be requested upon the full-priced ticket.

(4)

While chartering the Parlor Car, Bicycle and People car, Business Car of Taiwan Railway Corporation, Ltd., the fare of each car shall be calculated upon 25 people.

(5)

The fare of special express, tour trains and any customized train shall not be limited by the fare rate of trains in each level.

(6)

While the passenger is qualified for different preference (including special offer) programs at the same time, the passenger may only choose one program and cannot use repeated preference (special offer), unless otherwise announced and provided by Taiwan Railway Corporation, Ltd.

12.

During the pre-sale period of ticket, the limited amount for each person on each day shall be followed by the announcement of Taiwan Railway Corporation, Ltd.

Article 5. Valid period, usage regulations and precautions of ticket

13.

Valid period of tickets are as follows:

(1)

Full-priced ticket, child ticket and legal preference ticket:

1.: The ticket of Trains with designated train number and designated seat number shall only be valid in the designated train on the same day.
2.: The ticket of Trains without designated train number and with designated seat number shall only be valid on the day taking the train.
3.: If the ticket held by the passenger in the transportation of such train exceed valid period while taking the train, the passenger may still take the Train with such train number or designated transferred train till arriving the destination.
4.: Under other situations which the tickets are deemed to be valid by Taiwan Railway Corporation, Ltd., the ticket shall be valid till the designated valid period.

(2)

Group ticket: shall be handled according to announced deadline while selling.

(3)

Pre-paid ticket: shall be handled according to the usage regulation of pre-paid ticket.

(4)

Electronic ticket: shall be handled according to “Taiwan Railway Corporation, Ltd. Transportation Regulations on Multi-Card Electronic Ticketing”.

(5)

Other passenger passes or tickets issued by Taiwan Railway Corporation, Ltd. shall be handled according to the announcement or the valid period recorded on the tickets.

14.

The passenger who uses group ticket shall hold group ticket and group certificate while entering and departing stations, and any passenger who breaches the preceding provision shall be deemed holding invalid ticket and pay supplementary fare.
The minimum people amount of a group, pre-sale period, payment deadline, regulations on refunding (changing) ticket shall be handled according to the announcement of Taiwan Railway Corporation, Ltd.

15.

The precautions for the purchasing of tickets are as follows:

(1)

Passenger shall confirm whether the information recorded on the ticket is correct while purchasing and taking the ticket, and the passenger shall check if the received change is correct at the counter. When finding any mistake, the passenger shall immediately ask the ticket seller to modify without being charged any refund surcharge. If the passenger finds out the mistake after leaving the ticketing counter, it shall be handled according to the regulations of ticket changing and refunding of Taiwan Railway Corporation, Ltd.

(2)

If the passenger purchases registered ticket, it shall be deemed that the passenger has agreed Taiwan Railway Corporation, Ltd. to record any content (name, ID card number) which is sufficient to identify the ticket holder. To anyone who refuses to be recorded any above-mentioned content on the ticket, Taiwan Railway Corporation, Ltd. refuses to sell registered ticket.

(3)

While the passenger purchases disabled preference ticket, elder preference ticket, child ticket, registered ticket, Taiwan Railway Corporation, Ltd. may request the purchaser to present related proof and record related information. The passenger who holds preference ticket shall hold valid certificate for checking while taking the train.

(4)

The precautions for purchasing child tickets are as follows:

1.: Any child whose height is less than 150 cm shall be free of charge; any child whose height is more than 115 cm but less than 150 cm may purchase child ticket; any child whose height is more than 150 cm shall purchase full-priced ticket.
2.: Any child who is more than 150 cm tall but younger than 6 years old may be free of charge upon showing ID card; any child who is more than 150 cm tall but younger than 12 years old may purchase child ticket upon showing ID card.
3.: Any child who is qualified to take train free of charge shall be carried by the passenger who purchase full-priced ticket or adult passenger, and each passenger may only carry two children who is qualified to take train free of charge; the exceeding amount shall be requested the fare of child ticket.
4.: Any child who is qualified to take train free of charge shall not be provided the services of seat booking. If the passenger still intends to book seat of the train with designated seat number for the child while taking the train, the passenger shall purchase child ticket.
5.: The fare of child ticket shall be calculated as the half of adult full-priced ticket, and the amount less than one dollar shall be rounded to the nearest integer.
6.: The calculation of child’s age shall be based on the day taking the train, any child who is more than 12 years shall not purchase child ticket regardless of any height.

(5)

The precautions for purchasing elder preference ticket are as follows:

1.: Any citizen who reaches 65 years old or any person having permanent residency certificate who reaches 65 years old and has been marked the preference qualification for taking domestic public transportation on the permanent residency certificate may purchase elder preference ticket while taking the train.
2.: The fare of elder preference ticket shall be calculated as the half of adult full-priced ticket, and the amount less than one dollar shall be rounded to the nearest integer.
3.: The calculation of elder’s age shall be based on the day taking the train.

(6)

The precautions for purchasing disabled preference ticket are as follows:

1.: Any disabled people who possesses valid disabled certificate (Handbook for the Disabled) issued by the Competent Authorities of R.O.C. may purchase disabled preference ticket.
2.: One person of the required companions of the disabled people who possesses valid the Handbook for the Disabled issued before July 9th, 2012 may be qualified to use disabled preference ticket; however, one person of the required companions of the disabled people who possesses valid the Handbook for the Disabled issued after July 9th, 2012 may only be qualified to use disabled preference ticket with the mark of “Domestic Public Transportation” in the field of “Required Companion Special Offer Procedure” of Handbook for the Disabled.
3.: The fare of disabled preference ticket shall be calculated as the half of adult full-priced ticket, and the amount less than one dollar shall be rounded to the nearest integer.
4.: The required companion and the disabled people shall enter and depart the station at the same time. Any required companion who does not enter and depart the station with the disabled people at the same time shall purchase full-priced ticket.

(7)

The precautions for purchasing special offer ticket are as follows:

1.: The special offer is only for the purchasing before taking the train. Using the tickets other than special offer ticket, paying supplementary fare on the train or paying supplementary fare at the destination station do not apply.
2.: Any passenger who hold full-priced ticket in same level while taking the train will not be refunded.
3.: Any passenger who hold full-priced ticket which the level is higher than special offer ticket while taking the train will not be refunded; any passenger who hold full-priced ticket which the level is lower than preferable ticket while taking the train shall supplement the difference in fare according to the full-price of the level of the special offer ticket. However, if Taiwan Railway Corporation, Ltd. otherwise stipulates that the duty of supplement may be exempted or any fare shall be refunded, the exception regulation shall apply.
4.: Unless otherwise announced, Taiwan Railway Corporation, Ltd. does not publish group ticket for preference train.
5.: The refund, regulation and deadline of train changing for special offer ticket shall be handled according to the purchasing and usage regulation on preference train announced by Taiwan Railway Corporation, Ltd. If no such regulation announced by Administration, it shall be handled according to the Contract.

(8)

Other passenger passes or tickets shall be handled in accordance with the usage guide, recorded items or announcements of such tickets.

16.

After purchasing or taking ticket, the passenger may apply for proof of purchase before taking the train. The passenger may only apply for one proof for each ticket, and the proof will not be provided again if the passenger losses the proof. Afterward, while applying for the train change or refund, the passenger shall operate by presenting the original ticket and the proof of purchase.
Proof of purchase may only be used as the certificate of transaction between Taiwan Railway Corporation, Ltd. and passenger. Taking the train by holding the proof of purchase shall be deemed taking the train without ticket. If the passenger losses the ticket, the passenger shall not apply for providing the ticket again by presenting such proof of purchase or request a refund after purchasing another ticket.
After Taiwan Railway Corporation, Ltd. has agreed to take out and affixed the certificate stamp on the ticket, the ticket which has been used shall be deemed the proof of purchase and Taiwan Railway Corporation, Ltd. will not otherwise issue proof.

17.

While the passenger takes the train at the announced stations without ticketing personnel and ticketing equipment or machine has been set at the stations, the passenger shall purchase ticket before taking the train.
If no ticketing equipment or machine is set at the stations mentioned in the preceding paragraph, the passenger may take the train first and then actively pay the supplementary ticket fare to conductor. If the passenger does not actively pay the supplementary ticket fare to conductor and starts to claim that he/she takes the train at the station without any ticketing personnel when conductor is checking the ticket, the passenger shall be handled according to the regulation on the passengers taking the train without ticket.

Article 6. Change of Transportation and Refund of Ticket

18.

While the passenger purchases the ticket of trains in any level, the passenger may apply for refund within the announced deadline or apply for the change of transportation upon the approval of Taiwan Railway Corporation, Ltd. The change of transportation may only be operated at the ticketing counter of stations of Taiwan Railway Corporation, Ltd. or other designated places announced by Taiwan Railway Corporation, Ltd.
The tickets obtained free of charge shall not be applied for refund or change of transportation. However, in the event that the train’s late arrival meets the standards of compensation or the operation suspends, the passenger may apply for taking another train in same level in same section by presenting the original ticket one year after the happening of the accident.

19.

The regulations on the refund of general ticket are as follows:

(1): The latest time for applying for the refund of train ticket without designated seat number shall be the day taking the train; The refund of train ticket with designated seat number shall be applied before the departure of train, and it will not be accepted while exceeding the time.
(2): Passenger may apply for refund at the ticketing stands with computer connection or the places and channels announced by Taiwan Railway Corporation, Ltd.
(3): While applying for the refund of the ticket without designated seat number or the ticket with designated seat number but without seat, the refund surcharge shall be exempted. However, if the passenger applies for the refund of the ticket with designated seat number after changing to the ticket with non-reserved seat, the surcharge shall be calculated according to the transportation date recorded on the original ticket. If the changed transportation date is earlier than the transportation date of the original ticket, the refund surcharge shall be calculated according to the changed transportation date. If the refund date is later than the original transportation date, the refund surcharge shall be calculated according to the refund standards on the transportation date.
(4): Unless otherwise agreed by Taiwan Railway Corporation, Ltd., the ticket which has been used shall not be refunded.

20.

The transportation change regulations of general ticket are as follows:

(1): While the passenger holding any level’s train ticket with designated seat number applies for the change of transportation, the application shall be free of charge at the first time, and the change content of transportation shall be limited to the change of train number, date, train type, ticket type, seat number, and the change of the departure and destination station and direction recorded on the ticket shall not be applied. In addition, the change between the train ticket without designated seat number and the train ticket with designated seat number.
(2): In the event that the application is not included in the range set forth in the preceding subparagraph or the application for the change of transportation is submitted for the second time, the application shall be handled by refunding procedure and shall be charged refund surcharge.
(3): While the passenger first purchases the non-reserved seat ticket with designated seat number and applies for changing the ticket to the reserved seat ticket with designated seat number, such change will not be recorded as a change time.
(4): The change of transportation shall be applied 30 minutes before the departure of such train number on such day. In the event of exceeding the deadline, the application shall be handled by refunding procedure and charged refund surcharge.
(5): If the passenger finds before the approaching of the train that the operation suspends or the train is late for more than 30 minutes according to the arrival time recorded on the original ticket and the change of transportation cannot be handled, the original ticket may be refunded and exempted from surcharge.
(6): If the passenger applies for the refund of ticket after applying for the change of transportation, the surcharge shall be calculated according to the original transportation date recorded on the ticket. However, If the changed transportation date is earlier than the transportation date of the original ticket, the refund surcharge shall be calculated according to the changed transportation date. If the refund date is later than the original transportation date, the refund surcharge shall be calculated according to the refund standards on the transportation date.

21.

The standards for charging refund surcharge are as follows:

(1): Refund on the transportation date: each ticket shall be charged 20% of the ticket fare, and the refund surcharge shall not be less than NTD 20.
(2): 2 to 3 days before the transportation date (the transportation date is deemed the first day, same as the following provisions): each ticket shall be charged 20% of the ticket fare, and the refund surcharge shall not be less than NTD 20.
(3): 4 to 25 days before the transportation date: each ticket shall be charged NTD 20.
(4): 26 days before the transportation date: each ticket shall be charged NTD 10.
(5): If the ticket fare is not enough for charging surcharge, the ticket fare will not be refunded, and the supplement of surcharge will not be requested.

22.

The regulations of the refund of group ticket and the change of transportation are as follows:

(1)

Train group ticket without designated seat number shall be charged the refund surcharge of NTD 7 per person. The application of refund shall be submitted to the station before the departure of such train, and the application will not be accepted if exceeding the deadline.

(2)

Train with non-reserved seat ticket with designated seat number shall be charged the refund surcharge of NTD 7 per person. The application of refund shall be submitted to the station before the departure of such train, and the application will not be accepted if exceeding the deadline.

(3)

If the passenger has booked seat of the train ticket with designated seat number, the passenger shall apply to the station for refund one hour before the departure of such train, and the application will not be accepted if exceeding the deadline. The refund surcharge will be charged according to the following regulations:

1.: 1 to 7 days before the transportation date (the transportation date is deemed the first day, same as the following provisions): each ticket shall be charged 40% of the ticket fare.
2.: 8 to 21 days before the transportation date: each ticket shall be charged 30% of the ticket fare.
3.: More than 22 days before the transportation date: each ticket shall be charged 20% of the ticket fare, and the surcharge shall not be less than NTD 20.

(4)

If the passenger first applies for the change of transportation and then applies for refund, the refund surcharge shall be charged according to the changed transportation date.

(5)

There is no limit on the times of the application for refund of the train group ticket with designated seat number which seat has been booked; the application for the refund of train with non-reserved seat group ticket with designated seat number and train group ticket without designated seat number shall only be made for one time; if the remaining amount does not reach the stipulated amount for purchasing group ticket after applying for the refund of group tickets, all the group tickets shall be refunded.

(6)

After completing the purchasing of train group ticket with designated seat number, the regulations of the change of transportation are as follows:

1.: Within ten days (not including the day purchasing ticket) after purchasing ticket, each itinerary may request for changing train number, date, train type and amount for one time. However, if the application exceeds the period that group ticket is open for booking, Taiwan Railway Corporation, Ltd. will not accept the application.
2.: If the change of group reduces the passenger amount, the refund surcharge shall be charged according to the days before the transportation date.
3.: Each group ticket may be applied for the change of ticket type, which has been applied for the change of transportation may be applied for changing the ticket type again for one time.
4.: The application for the change of ticket type shall be submitted one hour before the departure of such train on such day.

(7)

The application of the transportation change of train group ticket without designated seat number will not be accepted.

Article 7. Regulations on Transportation of Passenger

23.

While the passenger takes the train, the passenger shall hold the valid ticket accepted by Taiwan Railway Corporation, Ltd. and takes the train in accordance with the regulations of ticket or the information recorded on the ticket. Any passenger who does not hold valid ticket shall apply for the transportation change or refund before taking the train. If Taiwan Railway Corporation, Ltd. finds out that any passenger has no ticket or holds invalid ticket to take the train, Taiwan Railway Corporation, Ltd. may reject the passenger for taking the train. If the passenger mentioned in the preceding paragraph has entered the station and taken the train, the passenger shall be charged equivalent supplementary fare. Unless otherwise agreed in the Contract, the original ticket or passenger pass which has been used or exceed the refund deadline may not be refunded upon the approval of Taiwan Railway Corporation, Ltd. The payment of the supplementary fare shall be handled according to the following regulations:

(1): If the passenger takes the train without tickets, takes the train by using the ticket or pass exceeding the valid period, the passenger shall be charged the payable fare from the departure station to the destination station. In addition, if the passenger has no due reason, the passenger will be otherwise charged 50% of the fare of the section which has been taken.
(2): If the passenger changes to the train or car in higher level at his/her own, the passenger shall be charged the difference in fare. If the passenger has no due reason, the passenger will be otherwise charged 50% of the fare of the section which has been taken. However, if the passenger meets the circumstances set forth in Subparagraph 8 of this Paragraph or holds special offer ticket, it shall be handled according to such regulations.
(3): If the passenger has the behavior of Taking Train Over Station (including Turn-back Transportation), the transportation section of Taking Train Over Station and Turn-back Transportation shall be deemed taking train without ticket and charged the supplementary fare. However, if the total amount of fare of valid section and the section of Taking Train Over Station is equal to or less than the fare recorded on the original ticket, the supplementary fare shall be exempted after Conductor has marked the place to get off the train. If it has not been marked by Conductor, the supplementary fare shall still be charged while exiting station.
(4): The passenger who shall purchase full-priced ticket holds the ticket or pass which does not meet his/her identity shall be marked “does not meet the identity” and shall be charged the difference in the fare from departure station to destination station, and 50% of the fare of the section which has been taken will be additionally charged if there is no due reason.
(5): If the passenger who is qualified to use preference identity holds full-priced ticket to take the train, the personnel in charge of checking ticket shall mark the preference identity and free of supplementary ticket fare on the ticket. The passenger may apply for the difference in the ticket fare without paying surcharge while the passenger leaves the arrival station.
(6): If the passenger is qualified to use another preference identity holds the preference ticket which is not consistent with his identity, the personnel in charge of checking ticket shall mark the correct preference identity on the ticket and return to the passenger without charging the passenger the supplementary ticket fare. If there is any difference of fare between different preference ticket, the difference in the fare from the departure station to the destination station shall be charged. In addition, if there is no due reason, additional 50% of the section which has been taken will be charged.
(7): The registered ticket shall be only used by the registered person. If the passenger does not show the certificate, shows invalid certificate, cannot be identified as the registered person or the ticket is not used by the registered person, it shall be deemed taking the train without ticket.
(8): If the passenger holds the ticket which is not consistent with such train or car on such date and take the train which is announced by Taiwan Railway Corporation, Ltd. that the tickets of such train or car without seat is not for sale (Such as New Tze-Chiang Limited Express, Group Train, Tour Train, Special Express, Business Express and Family Cabin, etc.), the passenger shall be deemed taking the train without ticket, and the passenger shall be charged the fare of the section which has been taken. In addition, if there is no due reason, an additional 50% fare of the section which has been taken will be charged.

If the passenger is unable to prove the departure station while supplementing the ticket fare, it shall be calculated from the starting station of such train. If more than two trains arrive in succession within 10 minutes, the fare shall be calculated from the starting station and charged according to the highest amount. If the passenger cannot prove the type of the train, it shall apply to the above provision. However, if Taiwan Railway Corporation, Ltd. otherwise agrees, it is not subject to the restriction. If the passenger refuses to pay the supplementary ticket fare, Taiwan Railway Corporation, Ltd. may cancel or terminate the passenger transportation contract or refer to police departments according to laws.

24.

The passenger shall collaborate with Taiwan Railway Corporation, Ltd.’s personnel for checking ticket.
If the passenger holds legal preference ticket, child ticket, registered ticket, the passenger shall carry valid certificate while taking train (shall not be replaced by copy or electronic photo), and the certificate and the original ticket (shall not be replaced by copy, electronic photo or any other media which is not approved by Taiwan Railway Corporation, Ltd.) shall be presented at the same time while checking ticket. However, if Taiwan Railway Corporation, Ltd. agrees in writing that valid certificate may be replaced by other methods, it is not subject to this restriction.
In the event of not showing certificate, showing invalid certificate, unable to identify such person, using ticket of another person while checking ticket, the passenger shall be deemed the identity is inconsistent. The passenger shall pay the full-priced supplementary ticket fare according to the provision of Point 23, and the original ticket will be refunded according to the Contract and it will not be accepted if the passenger applies for refund by presenting certificate and original ticket after the time of checking ticket. If the passenger refuses to collaborate with personnel to check ticket, Taiwan Railway Corporation, Ltd. may cancel or terminate passenger transportation contract, or refer to police departments.

25.

The passenger shall take the train in accordance with the information recorded on the ticket or the usage regulation of the ticket. If the passenger fails to take the train in accordance with the information recorded on the ticket or the usage regulation of the ticket, the passenger shall pay the supplementary ticket fare in accordance with the Contract or the usage regulation of the ticket, except with the consent of Taiwan Railway Corporation, Ltd. by signature, or otherwise stated in the announcement of Taiwan Railway Corporation, Ltd.
The ticket will not be refunded if the time for refunding has passed or the passenger has entered the station and used the ticket, except with the consent of Taiwan Railway Corporation, Ltd.

26.

The ticket held by the passenger shall be consistent with his/her identity, otherwise the passenger shall apply for the change of ticket before taking the train. However, if the period for changing ticket has expired, and the passenger is found that the identity is not consistent, the passenger shall apply for refund and purchase the ticket again. If the passenger who is qualified to use preference ticket takes the train with full-priced ticket, the passenger may handle in accordance with Subparagraph 5 of Paragraph 2 of Article 23.
At the time of purchasing the ticket according to the preceding paragraph, if the change of transportation has not been handled, the refund surcharge will not be charged. If the ticket has been marked with transportation change, the refund surcharge will be charge according to the standards of refund surcharge.

27.

Unless otherwise provided in the Contract, the passenger may take the train at any station in the section between the departure station and destination station within the valid period of the ticket. The section which has not been taken will be refunded. Within the valid period of the ticket, the passenger may get off at the middle station once after Taiwan Railway Corporation, Ltd. has approved and marked the time of leaving station and the name of middle station where the passenger gets off on the ticket.
The following acts shall not apply to the regulations on getting off at middle station in this Point, and the fare of the remaining section will not be refunded. If the fare of the section which has been taken exceeds the original ticket fare, the passenger shall pay the supplementary ticket fare. If otherwise stated in the Contract, it is not subject to the limitation.

(1): The passenger arrives the station with the same ticket fare as the destination station recorded on the ticket.
(2): Get off at the station without any personnel.
(3): Get off halfway without obtaining the approval of Taiwan Railway Corporation, Ltd. and being marked the departing time on the ticket.
(4): Hold the train ticket with designated train number and designated seat number and leave the station at the stop in the middle.
(5): The times to get off halfway exceed the stipulated times.
(6): The passenger who does not need to purchase ticket or holds free ticket gets off at middle station.

28.

Without the signature or announcement of Taiwan Railway Corporation, Ltd., if the passenger changes to the train in lower level at his/her own, the difference in the fare will not be refunded.

29.

If the passenger mistakes the train and takes another train, the fare of the mistaken section shall be supplemented as taking train without ticket or with invalid ticket. After the supplementary ticket sheet has been proved as mistaking the train, the passenger will be transported to the destination station recorded on the original ticket. If time recorded on the original ticket has passed or the ticket has been used, the ticket will not be refunded, except with the consent of Taiwan Railway Corporation, Ltd.
If the passenger who mistakes the train and takes another train according to the preceding paragraph gets off at the middle station between departure station and destination station and leaves the station, unless transportation has been suspended due to the breakdown of operation, the passenger shall pay the supplementary fare from the original destination station to the middle station where the passenger gets off.

30.

If the passenger gets off at the middle station due to injury or disease, the passenger may apply for refund of the fare of the section which has not been taken by proposing the relevant proof and the original ticket without being charged refund surcharge.

31.

If the passenger fails to take the train on time, the passenger shall handle according to the following provisions:

(1): If the passenger fails to take the train on time, upon the signature of the station, the passenger may take another train in same level or lower level on the same day without otherwise booking the seat. If there is no other train on such day, the passenger may take the first train in same or lower lever on the next day; however, the passenger cannot take the train listed in Subparagraph 2. If the passenger takes the train without obtaining the signature of the station, the passenger will be deemed taking the train without ticket.
(2): The not-for-sale ticket of train with non-reserved seat, tour train, group train or special train cannot be taken.
(3): The passenger who fails to take the train on time may add price and take another train in higher level on the same day. The passenger who applies for refund after adding price for purchasing another ticket will only be refunded for the fare of added price, and the fare of the original ticket will not be refunded, and the refund surcharge will be calculated according to the fare of the train in higher level.
(4): If the passenger otherwise purchases the ticket and takes the train, the fare of the original ticket will not be refunded.
(5): The group passenger who fails to take the train on time shall handle according to this Point, but Taiwan Railway Corporation, Ltd. may transport in different batches by considering the transportation ability.

32.

If the passenger losses the ticket, it shall be handled according to the following provisions:

(1): The lost ticket will not be provided again and will not be refunded.
(2): If the passenger losses the ticket before taking the train, the passenger shall again purchase a valid ticket, showing the same date, the distance with the same departure and arrival stations and the same train number, in order to board the train.
(3): If the passenger losses the ticket in the process of transportation, the passenger shall be charged supplementary fare according to the regulation on the taking the train without ticket, and it will mark loss of the ticket on the supplementary ticket sheet.
(4): While the passenger finds out the ticket, the passenger shall apply for refund of ticket fare to the station within one year by presenting the found original ticket and the ticket which is otherwise purchased or the supplementary ticket sheet. Every ticket will be charged for transaction fees of the 20% ticket fare, but no less than NTD 20. If there is any additional fare on the supplementary ticket sheet, the ticket fare on the supplementary ticket sheet and the additional fare will be refunded. However, if the ticket which is lost before taking the train has been cut or used, the ticket fare will not be refunded.
(5): If the registered ticket is lost, the passenger shall otherwise purchase ticket or pay the supplementary ticket fare before taking the train. If the original ticket has been proved that it has not been used or has refunded, the passenger may apply for refund by representing the ticket which is otherwise purchased.
If the passenger losses the group ticket, the passenger shall pay the supplementary fare of one full-priced ticket of the same section with the same train number as the replaced group ticket,and the group pass will not be provided again for such loss.If the passenger has found the lost ticket and applies for refund of ticket fare, 20%(No less than NTD 20) of the ticket fare will be charged, and the train without designated seat number shall apply as well.
33.: Upon approval of Taiwan Railway Corporation, Ltd., the passenger may purchase a platform ticket or exchange for access certificate to access the platform without staying at the station more than one hour each time.
If the passengers in the preceding paragraph stays more than provided time, the fare of starting mileage of Fu-Hsing Semi Express and other train in same level, except with the consent of Taiwan Railway Corporation, Ltd.
The regulations on the stay of time and penalty for electronic tickets shall be handled in accordance with “Taiwan Railway Corporation, Ltd. Transportation Regulations on Multi-Card Electronic Ticketing”.

Article 8. Handling Procedure of Transportation Accident, Late Arrival and Special Circumstances

34.

In the event of train delay, cancellation, service termination, train failure, or any reasons which cannot be attributed to the passengers, the passenger can request a ticket refund within one year since the date of incidence and will not be charged for the refund transaction fees.

(1): When the passenger is requested not to board the train at the departure station or transported back to the departure station, he or she can apply for a full refund for the ticket.
(2): If the transport service is terminated at any stops or the passenger chooses other transport carriers to continue the journey, the passenger can claim a refund for the journey which has not been finished.
(3): For those passengers who decide to change to take different trains or carriage types, they can request a refund for the specified ride which is transported with lower-fare carriage or train. However, they are requested to pay a supplementary fare when changing to take higher- fare carriage or train.
(4): If the passenger holds a ticket without indicating the fare or showing fare-free, that ticket fare refers to the full price of the ticket holder’s identity. However, other regulations are applicable if there are ones available.

The above refund policy does not affect passenger right of claiming a compensation according to civil law or other legislations.

35.

In the event of the suspension of operation or late arrival of train resulted from accidents, in addition to announce the sections of accidents and the delayed time of train, Taiwan Railway Corporation, Ltd. may suspend the selling of ticket and restrict passenger from entering station for waiting and taking train.

36.

If Taiwan Railway Corporation, Ltd. fails to transport passenger on time according to the time showing on train timetable, the compensation for late arrival, refund standards and methods of compensation shall be handled in accordance with “Regulations on Compensation to Passengers for Late Arrival of Train of Taiwan Railway Corporation, Ltd.” and “Table of Standards of Late Arrival”.

37.

If the ticket held by the passenger is damaged or broken, the passenger shall purchase another ticket for taking train. However, if the complete ticket number of such damaged or broken ticket can be identified, the passenger may submit the damaged or broken ticket and the ticket that he/she purchases again, and the fare will be refunded upon examination and approval of Taiwan Railway Corporation, Ltd.

38.

If the air-conditioner of train breaks down, the passenger which holds the train ticket which the seat has been booked may apply for refund of 20% fare of the section with broken air-conditioner. However, if Taiwan Railway Corporation, Ltd. has arranged another seat in the same train at the same time, or if the passenger holds the ticket without designated seat number, the application of refund will not be accepted.

39.

If there is any repeated seat number in any level of train with designated seat number, and no remaining seat in the same train can be booked at the same time, the passenger which has no seat due to repeated seat number may apply for refund of 20% fare of the repeated section according to the ticket type, and the amount less than one dollar shall be rounded to the nearest integer.

40.

If the passenger holds the train ticket which seat has been booked and the seat has been malfunctioned, and Taiwan Railway Corporation, Ltd. cannot arrange another seat in the same train at the same time, the passenger may apply for refund of 20% fare of the taken section upon signature of Taiwan Railway Corporation, Ltd.
If the malfunction of seat mentioned in the preceding paragraph is attributable to the passenger, Taiwan Railway Corporation, Ltd. will not refund the ticket fare, and Taiwan Railway Corporation, Ltd. may request for compensation to the behavior.
If the passenger does not sit in the designated seat or changes the seat at his/her own, and he/she finds that the seat is malfunctioned, Taiwan Railway Corporation, Ltd. will not refund the ticket fare.

41.

If the passenger encounters the situations set forth in Point 38, 39, 40 at the same time and meets the standards for refund, the refund fare set forth in subparagraphs of Point 38, 39, 40 shall be calculated first and then aggregated in the total refund fare for calculation.
The request of refund in the preceding paragraph will be handled as refund for late arrival if the train meet the standards of full refund for late arrival set forth in “Regulations on Compensation to Passengers for Late Arrival of Train of Taiwan Railway Corporation, Ltd.”.

42.

From the date of announcement of ocean typhoon alert to the date of cancellation of announcement of ocean typhoon alert , if any train booked by the passenger stops transportation, or if the passenger is not able to take the train due to typhoon, the passenger may hold the unused ticket to apply for refund at the ticketing counter of each station without being charge refund surcharge within one year after the time of departure date. If the passenger applies for refund at the channels other than ticketing counter of station, refund surcharge will be charged in accordance with the provisions of such channel.
The passenger mentioned in the preceding paragraph will not be refunded if he/she holds the ticket which has been used.

43.

Taiwan Railway Corporation, Ltd. shall be liable for passengers’ death, harm or any loss and damage of property resulting from the transportation of train and other accidents. However, if Taiwan Railway Corporation, Ltd. can prove that such accident is not incurred by the negligence of Taiwan Railway Corporation, Ltd., the compensation for passenger’s death or harm and the awarding of subsidy for condolence supplement and medical subsidy shall be handled in accordance with “Regulations Governing the Awards of Compensation and Subsidies for Transportation and Other Accidents of Railroad Operator” enacted and promulgated by MOTC.

Article 9. Regulations on Belongings (Including Bicycle and Pet)

44.

The carry-on luggage and items of passengers shall comply with the following provisions, or Taiwan Railway Corporation, Ltd. may refuse to transport:

(1): Each person may only carry two belongings at most which do not hinder other passengers, and the belongings shall be kept and taken care at his/her own.
(2): Each item’s length shall not exceed 150 cm, and the sum of length, width and height shall not exceed 220 cm. However, the wheelchair or the electric scooter announced by Taiwan Railway Corporation, Ltd. are not subject to this restriction. The baby carriage which meet the provided size of belongings after being folded may be carried while taking train.
(3): For emergency medical items, life-sustaining equipment which is necessary for sustaining passenger’s life, passenger shall apply for approval to Taiwan Railway Corporation, Ltd. before taking train, and they are not subject to the restriction of size of belongings. However, Taiwan Railway Corporation, Ltd. may arrange suitable train for transportation at its own discretion by considering the transportation ability.
(4): If the passenger carries balloon with him/her, the passenger shall release the air before entering station and taking train.
(5): If the passenger carries any dangerous items, dead bodies, bones of dead bodies, cremains and rotted and dirty items, or any other items which are announced by governments or Taiwan Railway Corporation, Ltd. to be in danger of harming or harassing passengers or railroad, the passenger shall not enter station and take train.

45.

The belongings carried by passengers shall be kept on their own, and Taiwan Railway Corporation, Ltd. will not be responsible for keeping custody. For instruments, god statues or any items which will occupy a seat, the passenger shall purchase additional full-priced ticket for such items.

46.

The passenger shall not carry pets to enter station, exit station and take train, but the following situations are the exceptions:

(1): Passengers can only carry pets, such as cat, dog, rabbit, fish, shrimp, small pet turtle, small pet bird or small pet mice (excluding house mice and Suncus murinus) on the train. But make sure that pets are in the 55 cm length, 45 cm width and 38 cm height’s box, and there is no danger of excrement leaking. Also, it can be carried while taking the train if it can put under-the-seat storage. If the pet stroller fits the size as mentioned above, passengers can carry it on the train too.
(2): The pets in the preceding paragraph does not include birds(except small pet birds), snakes and other ferocious beasts and any species which might harm passengers or affect public hygiene.
(3): Duty dog and trained dog in government departments, seeing-eye dog, hearing dog, service dog or the puppies taken by professional trainers while implementing trainings, and any other pet which is allowed to be carried according to laws.

47.

The regulations governing the passenger taking the train with bicycle are as follows:

(1): Passenger shall pack the bicycle in a carrying bag covered by complete cover without any part being naked (cannot be replaced by other plastic bags or items). If the size meets the standards for belongings, it may be taken free of charge while taking train. However, the above-mentioned bicycle shall be put in a space which does not block the aisle, or the space designated by Taiwan Railway Corporation, Ltd. The passenger who has applied for the train number for transporting items and packages cannot put in the luggage car as well.
(2): While the passenger takes the bicycle mentioned in the preceding paragraph which exceeds the size of belongings or without package or with incomplete package, the passenger shall take the train designated by the announcement of Taiwan Railway Corporation, Ltd. or apply for the transportation in luggage room. While transferring to the train designated by Taiwan Railway Corporation, Ltd. 50% of full-priced ticket fare of such train will be charged for the transportation of bicycle.

48.

If the passenger is in breach of the regulations of belongings while taking the train, he/she shall be handled according to the following regulations:

(1): Dangerous items: the passenger will be forced to get off the train at the nearest stop and exit the range of station at the nearest stop. If it is illegal item, he/she will be first referred to police departments for investigation and the ticket fare will not be refunded.
(2): Does not belong to or exceed the types of belongings: the passenger will be forced to get off the train, and the passenger shall handle the luggage transportation procedure again, or Taiwan Railway Corporation, Ltd. may refuse to transport. While refusing to transport, the original ticket will be refunded according to regulations.
(3): Pet: the passenger will be forced to get off the train at the nearest stop, if the luggage transportation procedure cannot be handled at the next stop, Taiwan Railway Corporation, Ltd. will refuse to transport, and the original ticket will be refunded according to regulations.
(4): Bicycle: in addition to charge the passenger the full-priced fare of the section which has been taken as the penalty, the transportation contract will be terminated and the passenger will be forced to get off the train at the nearest stop, and the original ticket will be handled according to the refund regulations.

Article 10. Amendments

49.

The following provisions constitute the amendments of the Contract. The part which is not provided in the Contract shall apply to the amendment. If there is different provision for the same circumstance, the amendment shall prevail.

Passenger Transportation Contract
